Terms of use

These terms are the agreement between you and us when you use Facetivo. Please read them before you buy. If you do not agree, please do not use the service.
1. Who we are
Facetivo is operated by SoftPotential OÜ, registry code 14565562, Kakumäe tee 226, 13516 Tallinn, Estonia ("we", "us"). Contact: hello@facetivo.com.
2. What Facetivo is
Facetivo is an online situational judgement assessment. You watch or read short real-life situations, choose what you would do, and receive a report on the strengths your choices show and where you have room to grow.
The report is a tool for your own development. It is not a psychological, medical or clinical assessment, not professional career advice, and not a prediction of how you will perform in a particular job. Do not rely on it as the only basis for important decisions about yourself or others.
3. Who can use it
You must be at least 18 years old. You use Facetivo for yourself, as a consumer, unless an organisation has bought access for you — in that case your organisation's agreement with us also applies.
4. Your access link and account
When you start, you receive a personal access link. Anyone who has the link can open your assessment and report, so keep it private and do not share it. You can also sign in to your Facetivo account with your email address and a one-time code.
You are responsible for keeping access to your email account secure. Tell us at once if you think someone else has your link or has used your account, and we will help you protect your results.
5. The free preview and what you can buy
The free preview lets you try one part of the assessment and see a preliminary result without paying.
You can then buy access to more of the assessment and to your full report, as offered on the site at the time. What each purchase includes and its price, including VAT where it applies, are shown before you pay. When you buy a larger option after a smaller one for the same assessment, what you have already paid is credited, as shown at checkout.
Payments are taken by our payment provider, Stripe. Your order is accepted, and the contract is formed, when your payment is confirmed. We email you a receipt.
Access to what you bought does not expire. If we ever close Facetivo, we will tell you at least 30 days in advance so that you can finish and keep your reports.
6. Your right to cancel
As a consumer in the European Union you normally have 14 days to cancel a purchase of digital content. Because Facetivo gives you access straight away, before paying you are asked to confirm: "I want access straight away. I understand that I lose my 14-day right to cancel once I start the assessment I have paid for." We confirm this in your receipt.
This means:
- before you start the part of the assessment you paid for, you can cancel within 14 days of your purchase and receive a full refund;
- once you have started it, the right to cancel ends.

7. If something does not work
If the service does not work as described, tell us at hello@facetivo.com. We will fix it within a reasonable time, and if we cannot, you are entitled to a price reduction or a refund. These rights come from consumer law and are not affected by the right to cancel or by our Refund policy.
8. Fair use
When you use Facetivo, please do not:
- share your paid access or your report's content with others as a service, or resell access;
- copy, record or publish the situations, questions or answer options;
- use automated tools to take the assessment, or to read or copy the site;
- try to get around our security, interfere with the service, or access other people's assessments.
We may suspend access that is being misused. Where possible, we will tell you first and give you the chance to explain.
9. Our content and your report
The situations, videos, questions, texts and design of Facetivo belong to us or our licensors and are protected by copyright. Buying access gives you a personal right to use them through Facetivo, nothing more.
Your report is yours to keep, print and share as you wish — for example with a coach, mentor or employer.
10. Your data
How we use personal data is explained in our Privacy policy and Cookie policy.
11. Our responsibility
We provide Facetivo with reasonable care and skill. We are not responsible for losses that were not foreseeable when you bought, for decisions you or others make based on the report, or for interruptions we could not reasonably prevent. We may change or improve the service, as long as what you have already bought keeps working as described.
Nothing in these terms limits our responsibility where the law does not allow it, including for death or personal injury caused by our negligence, for fraud, or your rights as a consumer.
12. Changes to these terms
We may update these terms, for example when the service or the law changes. The version you accepted when you bought applies to that purchase. We will tell you about important changes before they take effect.
13. Law and disputes
These terms are governed by the law of Estonia. If you are a consumer living elsewhere in the European Union, you also keep the protection of the mandatory consumer law of your country, and you may bring a claim in its courts.
If you have a complaint, please write to us first at hello@facetivo.com; we answer within 15 days. If we cannot resolve it, you may turn to the Consumer Disputes Committee of the Estonian Consumer Protection and Technical Regulatory Authority (www.ttja.ee), or to the out-of-court dispute body or the courts of your own country.
